Steering Towards A New India: Delhi HC Seeks Centre’s View On Same-Sex Marriage In India

One would assume that in 2020, we would all be living our lives as equals under a set of laws that treats us so. In the wake of the reality that this is not true, and seems like a far reach, too, India today has seen a slight ray of hope.

According to a report by NDTV, the Delhi High Court today sought the Centre’s response on separate pleas by two same-sex couples. Kavita Arora and Ankita Khanna sought to get married under the Special Marriage Act (SMA) while Vaibhav Jain and Parag Vijay Mehta sought the registration of their wedding in the US under the Foreign Marriage Act (FMA).

The bench that issued the notice for this matter consisted of Justice Asha Menon and Justice Rajiv Sahai Endlaw. A matter such as this, that that usually does not see the light of day in this country and gets ignored, will hold its hearing on 08 January 2021.

As the bench expressed, it is important to let go of age-old inhibitions. The two couples are just a tiny part of a large and vibrant community still waiting to avail their right to marry the person they love, regardless of biological sex or gender. Here’s hoping the country’s institutional authorities are able to treat such petitioners as humans and not just statistical blips.
